Brand New P5 Accident

1200 miles into my car and someone runs a stop sign and slams into my passenger doors... 9300 dollars worth of damage. Everything on the passenger side is ruined, the hood and bumper will need to be refinished, both rims replaced...

My problem is I'm on the edge of them totalling it but they won't. . . I so want to get a brand new one. Hate when someone screws up YOUR car and its THEIR fault, and you get screwed.

omg....I would be ready to kill someone....sorry to hear your misfortune.....

me personally....I really don't think I could stand it...and would do whatever I could to trade it in.....even if it was a loss....if there was that much damage....the car will never be the same....

the part that would make me the maddest....is I would know it was going to cost ME in the end....and probably a few grand.

There ought to be law, you hit a new car (less than a yr old), and you buy them a brand new one to replace it!!!

That really sucks. Make sure they find all the damage, like suspension, transmission, engine mounts, etc... A lot of components get knocked around and may not have visible damage but maybe misaligned (door/window latches on the opposite side).

Maybe it will add up enough for them to total it.

I agree on making sure they find EVERYTHING.....most of the time in a major wreck they find at least another 10-20% worht of damage after the start fixing it. Considering at the age of the car and with $9300 you are already over 50% of the new car value, I'd make some more phone calls to the insurance companies involved (yours and the other drivers) and not take No! for an answer.....

I hate to hear that man, I agree that I would probably be killing someone right about now. I can't believe they won't total it for that amount of damage. I know it is based on a precentage of the cars value, but come on that is crazy. Well sorry to hear that this happened but atleast it sounds like you are okay.

I agree, it will never be the same.
If they wont total it look into salvage auctions.
That's where ins. companies send them if they are totaled.
Ask what $$ your car might bring at auction.
May be better to sell as is and take ins. $$ and buy new.

That really sucks. You should keep trying with the insurance company. Usually it helps, but it depends on the adjuster. If you know a shady body shop, they may be able to help you out. The damage may not be that bad. Remember, the estimate includes the cost of the parts. I'm pretty sure that most of that estimate is for the cost of the new parts. Since the car is so new, parts from a junkyard or aftermarket panels may not be available. From what you describe, it sounds like you were side swiped, and not T-boned. T-boning can cause severe frame damage, but usually side swipes can be repaired with very little adverse effects.

Definately make sure that they find everything that is wrong. Even if you hear the slightest rattle anywhere or even if there is something wrong on the complete other side of the car get it fixed. I got rear ended at about 50 mph (and I was completely stopped) when my car was only about 7 months and they fixed the back end so that it looked great, but then I started to get rattles and other noises and I started having engine problems and sounds and found out 4 months later that I had cracked motor mount and a couple other problems. And I had to pay for them. Just reiterating to be careful and check all their work after they're finished. Remember, if you don't like the way the work was done they still have to fix it until you drive away from the shop.

I am kind of skeptical. I would take pictures of the damage and take it to a shop. With that level of damage, their has to be a compromise of the car frame. No matter how much they fix that vehicle, the frame is messed up. See if you can have a different insurance adjuster take a look at your vehicle. If they respond that they already sent one out, tell them that you would like a second opinion on this matter. If they have email, take some digital pics and send it to them for review.

This is just how I would approach this matter.

Lightbulb Diminished Value!

Make sure everyone knows you intend to make a claim after repairs are complete for diminished value. This is the difference between the cars value before the wreck and it's value after repaired. Do some research on Dim Value appraisers and contact several to see who sounds competent, then follow their instructions exactly. Don't pick up the car before they appraise it , etc. Their services may cost $500, but may recover $2000-$3000 dollars in compensation, plus their fee.
Simple discussions of this may push the insurance company over the top and get you a new car.

If you want to get your car written off. You should demand NEW parts for your car. Chances are that the quote they gave you is for just replacement (USED) parts. Most insurance companies use the used parts unless told by the insured that they want new parts.
Do you have replacement insurance on your car( the insurance company buys you the same model, but in the new model year for the first 2 years that you own it)?

I don't think we have 'replacement' insurance here. I do however have 'gap' insurance. Which means the amount owed on the vehicle is paid, as well as the deductible amount. Basically it means I go back to where I started from... and the dealership will give me 1000 to buy another car from them should this happen.
It is nice... but no where near as nice as replacement insurance.

I haven't heard of depreciated value that high... I was reading the law on it and it applied a formula based on the value of the car x 10% x a mileage factor x a damage factor... by my estimates it would be somewhere around 1200, which is pathetic considering I doubt anyone will ever want to buy the car for more than that off retail pricing.

If you look through all of the pictures you will notice that there was alot of damage underneath. The frame was bent and they had to cut off part of the front end. All of the body panels on the front of the car are new including bumper, bumper cover, hood, fenders, motor mounts, and the lint goes on and on and on. Im just happy that they did a kick but job on the paint and you real cant tell it was hit. It cost alot but they really did quality work.
