Yes it is. A Judge doesnt make the law,he enforces it...Law says the driver is the responsible party,not an Insurance company. An insurance policy is a "contract", which is binding. Insurance policies have a limit of liability, meaning that they will cover up to a certain amount of the driver's liability in an accident. In no way does this make the insurance company the responsible party. Technically the driver is supposed to pay ALL of the damages, and his insurance company will reimburse him up to their limit. To make it easier usually the insurance company will issue the check directly to the "victim" of their driver's negligence.

Why is it when you tell someone on the board they are incorrect they can't just simply accept it. It's always, "nah-uh, the guy at the corner gas station says different, so I 'aint gonna believe your list of facts".

4. Your fourth point is understood, however the "defendant" would be the driver at fault, not the auto insurance company

5. The word is sue, not sew. Sew is something you do with needle and thread

6. I am not a lawyer. However my job requires me to deal with auto insurance claims EVERY day. Especially situations such as Focal's. It more than qualifies me to give the proper info in this particular situation.

7. EVERY time I see someone give out FALSE information as advice and treat it as gospel, I will "talk down to them", as you call it

Tell me exactly how is it you know what I do ?

I don't work for a dealer. I work for Ford Motor Credit,in legal. We are a bank. We are the lein holder. We are the ones who get the checks when insurance companies payoff total losses. I work closely with insurance companies on a daily basis. I am VERY familiar with this process. If Focal Flare has a lein against this vehicle, and he refuses what the insurance company offers, trying to get his attorney involved to negotiate something different, the leinholder will end up settling with the insurance company directly. The way they have to do this is by getting a REPO title on said vehicle to give to the insurance company. Thus Focal would end up with a reposession on his credit !! He is much better off settling with HIS insurance company, then letting them settle with the other driver.

Macdaddy is right about my situation. it is not the insurance's fault. it's that fu**ing biotches fault for having a $7500 max on her liability. Oh and guys i cannot buy it back from the insurance comp. strictly b/c my wallet is flicking me off (not enough $$) so about parting it out it aint gonna happen. i really hate making you all wait to tell you this. i feel really bad. plus i still owe $2,000 some odd dollars after my insurance comp. pays me what my car is worth. I AM SOOOOOOOOO PISSED RIGHT NOW. <<once again i deeply apologize for the long delay>>

You may want to consider getting gap insurance on your next loan. That way you won't have the deficiency balance again.

we financed through the dealer and it wasn't offered through used cars. Normally it would be w/new however it was not offered through the used car

Your primary insurance company should offer gap insurance too, regardless whether it's used or not.
