ISP's Blocking Peer to Peer
This Letter was given to us to send out to customers.
Dear Prairie iNet Subscriber,
As you are aware, the Recording Industry Association of America-RIAA and several recording companies have set out to prevent the sharing of copyrighted music to protect their artist’s rights. Following the RIAA lead, are the companies that own copyrighted movies and games.
Record companies, movie studios and software companies are now pursuing individuals through their Internet Service Providers. Connecting to most peer-to-peer networks exposes a computer user’s Internet address, which is being traced back to the ISP. The copyright owner then sends a copyright infringement complaint letter to the ISP ordering that the illegal activity cease. So either the ISP must block the application or forward the letter to their customer and hope that their customer will cease the illegal activity.
Recently, in a 9th Circuit Court of Appeals Case, the 9th Circuit has laid out a test for holding third parties liable for contributory infringement for providing file sharing technology or transportation of those files. According to the court, contributory liability may be imposed on a file sharing technology provider who:
1. receives reasonable knowledge of specific infringing files
2. knows or should know that such files are available on the system and
3. fails to act to prevent viral distribution of the works. .
Currently, Prairie iNet is the nation’s largest high-speed wireless Internet provider and subject to much scrutiny by these copyright protection groups, so as a company we have opted to restrict Internet applications that have been identified as applications which allow the illegal sharing of copyrighted movies, games or music. If the application provides for the legal sharing of music, games, or movies, the application will remain unrestricted.
This legal battle over sharing copyrighted material is a complicated matter as companies such as Napster and Kazaa have found. Subsequently, we are choosing to voluntarily restrict these applications to avoid any future legal problems, for our customers and Prairie iNet. Our right to restrict these applications is covered in the Prohibited Uses of the Service of your Subscriber Agreement. We will continue to monitor the court cases and if the court position changes, we will be happy to unblock these applications.

Thats one of the biggest loads of crap ive ever heard! Sure i could say that they have no right to do that, but they clearly state their reasons and how they plan to back their reasoning, so atleast it was a good straight forward letter. But, if you dont like this, just switch to something else.... find a better provider or something.... sucks to hear that its coming to this though.
