now this is what happin? i was drivin of course and i look over(lights still green)and i look back and this big *** 97 dodge ram pickup (all jacked up off the ground)is stoped so i try to stop and with my shity tires just kept going and went under the back end of his truck and his tow hitch went right up my hood through the fire wall through my winsheild and broke my dash board so he calls the police and they come but before they get there i have some ***** slam his brakes on well where all standing around my car and he swerves off the road and comes within like 2 feet of smashing into the rear of my car so now i get the report from the cop that its nobodys falt and i drive the car home (can hardly see out my windsheild cause of it being all cracked so now im waitting for the person to come to my house to take alook at the car and see what needs to be done...now i was told that if the cost of fixing the car is at least 80% or 75% that they will concider the car totaled and ill be able to get a new one im getting a p5 or a mazda 3 this time if they do pay the car off and i get to get a new one......but anyways anybody got anyclue how much it would cost to get fixed? and i payed $8,866.00 for the car....is this statment true that if it cost 80% that the car can be concidered totaled and i can get a new one?

I can't believe that cop let you off without a ticket! The chances of rear ending someone and not getting a ticket are pretty darn slim, and generally for a good reason. Needless to say, if I was the owner of the Ram, I'd be pretty pissed at the moment, unless he had no damage.

By the way, do you understand the use of punctuation? I know its been mentioned several times, but really......?

well, it's a discontinued model. plain sedans don't have any resale value sadly when compared to the p5/msp/mp3. I bet he's totaled out.

NOt a doom-sayer....thats just a lot of damage and if it came through the firewall into the passenger cabin thats BAD.

Good luck Zepplin.

I am very sorry to see your protege with a horrid wound like that. I truely can sympathize.

Here's my situation:

Well when a minivan hits a stopped BMW X5 at 50 mph in front of you, and you also dont have time to stop, and you rear end the minivan and get $8700 worth of damage to an 02 p5, the insurance company will do anything they can to not total the car. They told me the the car has to be damaged to the point that the cost of fixing is around 75% of the value of the car, then they would have totaled it. The catch was that they are not looking at KBB price for the value of the car, they over estimate the value so that they can avoid totaling it. This is how I was able to keep my Pro5, weather I wanted to or not.

Anyways, my guess is that, even know that is a LOT of damage and it looks like it could easily be totaled, your insurance company will not total it.

Good luck with it, keep us updated on the decisions made.

-Brad.

yeah, insurance companies don't go by KBB or edmunds. They also don't look at retail value...they look at WHOLESALE value and I hate to say it but an 02 protege sedan only brings about $5K at auction. If he's done $3500 worth of damage then that car is toast.

I wish him the best. If this doesn't turn out he could be rolling in a new 3S and outrunning me!!

No they don't...Matty I deal with Insurance companies claims every day..I work at Ford Credit....they pay on ACV = Actual Cash Value or in laymans terms Average Retail when a car is considered totalled.....once they send the leinholder an ACV then we send them a LOG = Letter of guarantee...saying if they pay the agreed amount we will release the lein and issue them a title....I know your knowledgeable on cars, but I am seriously a professional at this...this is how I make my living....

I see....my dealings with insurance has never gone this way but I've only totaled one vehicle and it was worth nothing to begin with.
