Got a ticket
 
Ok so im drivin home and I get pulled over on the parkway. I was doin 80 in a 55 zone, yeah I know I deserved it but I was seriously just keeping up with traffic. Any way the officer is really nice and only gives me a ticket that says that I wasnt' waring my seat belt.

Now here is my question does this thing increase my insurance and if im pulled over again for something will I still show a clean record?

depends on state, insurance company, etc. here in pa, not wearing a seatbelt is a primary offense, meaning if they see you without seat belt, they can pull you over.. just don't speed in that area anymore... dunno what to tell ya. just because you stay in a pack of cars of 5 or more moving at 110 mph, doesn't make it right nor legal for you to travel that fast if the speed limit is 55. and as my friend's father repeats, people who think this ARE stupid.. a cop is going to pick a car and pull it over, it's simple as that, you could be first in the pack, last, or in the middle, you run a chance of getting singled out.

The funny thing is that I was wearin my seat belt. He told me that he was going to give me a seat belt ticket the smallest one ($42) he could give instead of a speeding one wich would have cost me $233 and 4 points on my lisence.

The ting is that we went moving in a pack of 5 there was like more cars then could be counted he just decised to pick me off.
Then he gave me the hold if everyone jumped off a bridge would you thing.


Does anyone know if my insurance will go up im in new jersey. The cop said it wont go sky high does that mean it will go up at all.

Hmm, I would suggest these things:

1) Find out what kind of seat belt laws you have in your state... For example, MA cops can pull you over for, say, speeding and write you up for not wearing a seat belt as well. However, they can't pull you over just for not wearing a seat belt. This is called "secondary" enforcement. Anyway, also check to see whether this is a moving violation... I don't think that it is. Typically, non-moving violations (such as parking tickets) don't up your insurance, and don't cost you any points on your license.

A good place to find this stuff out is your local public library (ask a reference librarian)

2) Call your insurance company, from a phone other than your home phone, and without identifying yourself, ask whether seat belt tickets affect your rates (claim you're shopping around for insurance companies).

Did you actually have your seat belt on?

If you weren't wearing it, then I guess you do deserve the ticket... but you can still try to fight it.

If you were wearing it, then fight the ticket. Here's a web site that may be helpful in fighting your seatbelt ticket. Just as a note, while that site promotes "seat belt choice", I think anyone who's not wearing a seatbelt in a car and dies as a result of not doing so when getting in a car accident, probably deserves it.

Finally, you were going with the speed of traffic, and thus were driving safely. Don't beat yourself up, you didn't deserve to be pulled over or ticketed.

I don't think calling officers "fuckin pigs" is necessary, seeing as how if they ticketed you, you deserve it. Their job is to protect everyone. Also, you say you have an '03 MSP with a 4-2-1 header...how is that possible? Did you take off the turbo? :rolleyes:

I disagree and agree at the same time. It may have been safe to be doing 80MPH, I won't argue that. BUT, speeding does deserve a ticket. It's the risk you take when you speed, it's the law. You have to take into consideration the risk you put other people at, not just yourself.

defensive speeding is not an excuse (aka going the same speed as other cars)

he wrote him a no seatbelt ticket instead of the enourmous speeding ticket as a favor.

seatbelt violation isn't a moving violation which means no points against your licence which means no insurance hike....unless your in a state where any traffic violation has to be reported to your insurance. go to your DMV website and look it up.

I don't know if your insurance will go up but it usually takes a while for the ins. company to catch it. Beware that most ins companies, varies with different company policies, keep records of tickets for up to three years so you can still be paying higher ins for up to three years after you get your tickets. I know mine just went up for careless and passing in a no passing zone from a ticket that happened over a year ago. My ins won't go back down untill 2005.

I disagree that speeding does deserve a ticket. You put yourself and others at risk more by going 55 or 65 when everyone else is doing 80 (by causing everyone to pass you). Speed variance is really the problem (also see this publication by Virginia DOT). The speed limits themselves are set too low. If it's 55 and everyone's doing 80, then I bet that less than half of the traffic is complying with the speed limit. What kind of a law is that where half the population is violating it? It's a law that needs adjust, is what it is.

The speed limit should be set at the speed that 85 out of 100 cars travel at or below. The other 15 percent tend to be true speeders and reckless drivers. If the speed limit was set to 75 or 80 on that road, then I bet that the roads would be safer. This is because folks who are doing 80 will keep doing 80 (they won't go faster because of that self-preservation instinct), and those who do "the speed limit" will bring their speed up to be more in limit with the rest of the traffic. Less speed variance will result in less passing and safer roads.

You may not believe it, but recently Italy raised their highway speed limits from 130 to 150 km/h (~80 to 93 mph) to improve safety.

In Norway, speed limits increased from 90kph to 100kph and resulted in fewer accidents. (which are pretty darn low speed limits to begin with...)

After Montana has eliminated "no speed limit" on certain highways and instated a speed limit, accidents on highways increased.

All in all, speeding law enforcement primarily serves as a money making venture, not a safety venture.

I looked throught the dmv site and they dont have it listed as a moving violation or listed anywhere for that fact.

Any one from NJ on this board how bout a little help.

I think ill be fine it takes two small tickets before any hike, from what I understand

About my record? anyone will this show up if someone runs my stuff.

The facts:

1. Police are the enemy. Avoid at all costs. (On the road I mean)
2. Speeding is legal as long as you don't get caught.
3. Speeding can be dangerous and should only be done by competent drivers with radar detectors.
4. Not wearing your seatbelt is just plain retarded.

I wore my dam seat belt! Does no one read these things?

If a cop would have caught me with a radar detector i would have been raped i mean cut no slack a $250 ticket and 5 5 points on my licence.
