2014 Mazda 3 with e-brake failure?

Hi there,

I have a brand new Mazda 3 (less than 3,500 kms).

This morning I rolled out of my house ready for work when I observed my car, rolled onto the car behind it on our street.

I had the e-brake pulled firmly up (and you could see the e-brake was on from the window) and even had my tires pointed the correct way on the tiny little incline that is my street.

Has anyone had this problem? How do I go about dealing with the dealership etc. regarding 1) the e-brake itself and 2) the damages caused by the e-brake failure to both my car and my neighbor's car?

Thank you for all of your help,

I just thought I would add:

-The car was parked about 50ft from the car it rolled into.
-The e-brake holds on most hills UNTIL an event happens such as someone bouncing in the car softly. The e-brake then creaks loudly (still holding the park) and then will feel 'settled' for a few more moments until the creaking noise re-appears and he car does the same.
-wait an hour or so and the brake is completely loose leaving the car to freely go where it so boldly wishes ;)

Is this a manual or automatic? If manual did you leave it in gear? If automatic did you leave it in park? How far do you pull your brake handle?

Remember the parking brake is just the rear brakes, and enough force will overcome them.... physics and all.
