E-Brake Light

First what I'm driving:
2000
DX Sedan

The problem:
When I press on the brake, (only while moving, not just sitting idle) the e-brake indicator light will come on,and usually stay on until I come to a stop or give the car a little lurch forward; sometimes it does not go off when I come to a stop.

I've done a search on here and have read that this can be the cause of low brake fluid or needing new brakes. So my question(s) would be, is this really the case? And if so, how do I know if I just need to fill up my brake fluid or if I need to get some new brakes?
The brakes seem to work ok, no squealing or anything, so... I'm confused.

Thanks for your help, I appreciate it.

the brake master cylinder has a clear box wit ha "full line" on it. You should be able to just look at the box and see the fluid level. Also, most quick lubes will do free brake inspections to check your pad/rotor wear. Have someone look at the system for free but make them actually show you the wear before you agree to fix anything.
